HEAT Bootcamp and Personal Training Release, Covenant Not to Sue, and Waiver

I hereby acknowledge and agree to the following: 1. HEAT Bootcamp (High Energy Athletic Training, Inc) coaches are not physicians and are not trained in any way to provide medical diagnosis, medical treatment, or any other type of medical advice. If there is any reason I may not be fit for intense exercise, I agree to consult a physician immediately. 2. I have been told if I feel tired, pain or feel out of the ordinary in any way either related to HEAT’s training or otherwise, I should contact a physician at once. 3. Boot camps and the training provided by HEAT carry with it potential for damage or loss of property, serious injury and death, including, without limitation, exposure to a contagion, infectious disease, virus, or illness, including, without limitation COVID-19 (individually an “illness” and collectively “illnesses”). I assume full responsibility for the risks of participating in these types of events/activities including the inherent dangers of the natural elements and illnesses. I do hereby consent to participate in HEAT’s program which will include strength, resistance, agility, endurance /or cardiovascular exercise. I have been informed and understand that physical exercise has been associated with certain risks, including but not limited to musculoskeletal injury, spinal injuries, abnormal blood pressure responses, and, in rare instances, heart attack or death. Every effort will be made to minimize these risks. Any information that is obtained regarding my fitness level and my progress will be treated as privileged and confidential and will not be released or revealed to any person other than my physician without my expressed written consent. I have read and understand the foregoing consent to participation in said program. I am aware that I may discontinue participation in the program at any time that I see fit to do so. If at any time I have questions concerning the content, policies, or procedures of the training program, I will discuss these questions with a member of the HEAT staff. In addition, I agree to the following: a) Release, discharge, and waive any and all responsibility from HEAT and those individuals affiliated as trainers or staff from and against any liability for injury, illnesses, including death, and for damage to or loss of property which may be suffered arising out of, or in any way connected with the participation in this program, and b) Indemnify and hold HEAT, and those individuals affiliated such as trainers or staff from and against all liability, claims, demands, actions, loss, and damage arising out of my participation in said training program. 

I understand and agree that this release includes any claims based on the actions, omissions, or negligence of HEAT, its employees, agents, and representatives, whether an injury or illness occurs before, during, or after participation in this program.  I hereby acknowledge that, from time to time, photographs and/or video may be taken during HEAT classes and events. I give my permission for my likeness to be used in any media and/or marketing that may be created from said content.

Personal Training

Rates: To be agreed upon by trainer and client prior to the start of the session

Attire: Wear comfortable tennis shoes. No flip-flops allowed.  Appropriate workout attire is needed. Due to summer heat, wear layered clothing that is comfortable and easily breathes.  Heavy clothing is not recommended.  You must bring a water bottle with you to every session in order to maintain hydration.

Training sessions will begin promptly at the time specified.  Payment must be made prior to participating in HEAT Personal Training.  Your training program registration is not guaranteed until payment is received.   Cash or Credit card payments may be accepted.  Each personal training session is approximately 60 minutes in length unless otherwise changed by the trainer. Clients are expected to begin working out at the start time of the scheduled appointment. A late start time does not entitle a client to a session longer than the scheduled appointment time of 60 minutes.

Cancellations: 24 hours notice is required for a cancellation or rescheduling in order to receive credit for the session. Failure to cancel within this time frame or failure to show up for a session will result in the client being charged for the full amount of the session. Exceptions will only be made in the case of a medical emergency, and at the trainer’s discretion.  In the event you are injured and unable to complete your purchased sessions, High Energy Athletic Training, Inc may refund a partial amount of your training fees upon receipt of a physician’s release stating you are unable to complete your exercise regimen.  If you need to cancel or reschedule a session, please call your scheduled trainer.  

Reimbursement or credits: HEAT Personal Training does not offer refunds or credits, so please be sure that our services will match your needs before committing to payment.  If any medical conditions or injury becomes present during the session it is up to the discretion of the HEAT trainer and the owners to determine if any refunds will be given.  Any sessions that remain after the expiration date will be forfeited. 

Injury: You are fully responsible for any injury you incur before, during, or after workouts.  The trainer and/or HEAT Bootcamp will not be held accountable in any manner, legal or otherwise. Any injury incurred before, during, or after workout sessions is solely the responsibility of the client. Focusing during your workout and following directions will help prevent any injury. It’s the client’s responsibility to communicate any symptoms or discomfort during the session.

No verbal agreement can alter or change the conditions of this agreement in any way.
